Bankruptcy Creditor's Rights Groups


Kass, Shuler, Solomon, Spector, Foyle & Singer, P.A. attorneys have represented the rights of Creditors in the Bankruptcy forum since 1974. The firm represents the interests of General Motors Acceptance Corporation, Ford Motor Credit Company, First Union National Bank of Florida and many National and Regional Corporations. Through our main office located in Tampa, we represent clients throughout the Middle District of Florida, including Fort Myers, Orlando, and Jacksonville Divisions.

Objectives of the Creditor's Rights Group
1.) Offer a volume fee structure for the protection of creditor's rights in assets such as automobiles, boats, and other personal property, and;
2.) Create individual strategic solutions for the secured and unsecured claims, which would include the interests of the private and institutional mortgages and floor plan lenders.

In addition, we offer extensive experience with regards to adversary proceedings to determine the dischargeability of debts, preferences and fraudulent conveyances. We also have significant experience in claims litigation, valuation of collateral and contested matters such as objections to confirmation in Chapter 11 and 13 cases.

Mark J Bernet

Born Baraboo, Wisconsin, 1961; admitted to Florida Bar, 1986, United States District Court, Middle, Southern and Northern Districts of Florida, United States Court of Appeals, Eleventh Circuit, United States Supreme Court. AV rating, Martindale-Hubbell. Education: University of Wisconsin (B.A. Journalism and B.A. Political Science, 1983); Notre Dame Law School (J.D. 1986), member of Notre Dame Law Review. Member: The Florida Bar, Hillsborough County Bar Association, American Bankruptcy Institute, Tampa Bay Bankruptcy Bar Association. He is a partner in the Litigation Department and has concentrated his practice in the area of business litigation, including the areas of complex commercial litigation and creditors' rights in bankruptcy. He has served on numerous occasions as a court-appointed receiver in cases involving substantial fraud, and he also has served as a Chapter 11 Trustee in a Chapter 11 bankruptcy case involving a ponzi scheme.

Larry M Foyle

Born Detroit, Michigan, 1953; admitted to Florida Bar, 1980, United States District Court, Middle, Northern, and Southern Districts of Florida and United States Court of Appeals, Eleventh Circuit. Education: Oakland University and University of South Florida (B. A. History, 1976); Stetson University (J. D., cum laude, 1980). Law Clerk to the Honorable Alexander L. Paskay, Chief Bankruptcy Judge, Middle District of Florida, 1980-1981. Member: The Florida Bar; Tampa Bay Bankruptcy Bar Association. AV Rating, Martindale-Hubbell. Mr. Foyle is the head of the Bankruptcy Creditor's Rights Group. He represents primarily creditors in bankruptcy cases with an emphasis on various commercial issues and consumer issues relative to finance companies and credit unions. Mr. Foyle lectures on topics pertaining to bankruptcy issues, consumer and commercial, for various trade groups and associations. He has been an active soccer coach and AAU basketball coach.

Brad W Hissing

Born Ft. Lauderdale, Florida, 1965; admitted to Florida Bar, 1990, United States District Court - Middle, Northern, and Southern Districts of Florida. Education: Emory University (B.A., 1987); Vanderbilt University School of Law (J.D. 1990). Member: The Florida Bar, Hillsborough County Bar Association, Tampa Bay Bankruptcy Bar Association. Mr. Hissing heads up the firm's Credit Union Practice Group and primarily represents secured creditors in bankruptcy proceedings and also represents unsecured creditors in dischargeability actions and transfer avoidance actions. He has over ten years experience in bankruptcy matters and has previously represented several Chapter 7 Trustees and numerous consumer debtors. Mr. Hissing is a frequent seminar speaker and lecturer on issues involving bankruptcy practice and procedure. Mr. Hissing is a Board Member of the Riverside Heights Homeowners' Association and frequently serves on the Gasparilla Festival of the Arts Committee.

Nicole M Mariani

Born St. Petersburg, Florida, 1984; admitted to Florida Bar, 2009. Education: Florida State University (B.S. Political Science, 2006); Stetson University School of Business Administration (M.B.A. 2009), Stetson University College of Law (J.D. 2009), President, Student Bar Association, Stetson Ambassador. Member: The Florida Bar, Hillsborough County Bar Association and Young Professional Member, St. Petersburg Area Chamber of Commerce.

Laura E Noyes

Born Stamford, Connecticut, 1983; admitted to Florida Bar, 2009, United States District Court-Middle District of Florida 2009, US Bankruptcy Court –Middle District of Florida. Education: Davidson College (B.A., 2005); Florida State College of Law (J.D. 2008). Member: The Florida Bar, American Bar Association, Phi Alpha Delta, Hillsborough County Bar Association. Awards: Pro Bono Award.

Melissa R Rinaldi

Born Clarksburg, West Virginia, 1982; Graduated from Florida Coastal School of Law (J.D., Certificate in International and Comparative Law 2007), Admitted to the Florida Bar, United States District Court, Middle, Northern, and Southern Districts of Florida. Undergraduate Degree from Flagler College (B.A. Political Science and Pre Law, 2004). Participant in the Caribbean Law Clinic, in Grand Cayman Island. She is currently a member of the Florida Bar, Florida Bar Real Property, Probate and Trust Law Section, and the American Bar Association. She practices in the areas of Real Estate, Foreclosure Litigation, and Bankruptcy Law.

Ashley L Simon

Born Tampa, Florida, 1983; admitted to Florida Bar, 2009, United States District Court, Middle District of Florida, 2009. Education: University of Florida (B.A. English, Cum Laude, 2005); Stetson University College of Law (J.D., 2008); Phi Beta Kappa. Member: the Florida Bar, Real Property, Probate and Trust Law Section; American Bar Association; Hillsborough County Bar Association. Volunteer facilitator at LifePath Hospice Children's Grief Center. Participant in the Summer Institute in International and Comparative Law in The Hague, Netherlands.
